Online Commissioning

Can’t make it to an office? In Ontario, you can have your documents commissioned from the comfort of your home or office using a secure video call. Under Ontario Regulation 431/20, remote commissioning is a legal and permanent option for residents.

How Remote Commissioning Works

1. Preparation: You upload or email a digital copy of your document (PDF or Word) before the appointment.

2. The Video Call: You meet with the Notary/Commissioner via a secure platform (like Zoom, Google Meet, or a dedicated notary app). Both parties must be able to see, hear, and speak to each other in real-time.

3. Identity Verification: You will hold up your original government-issued photo ID to the camera for the Commissioner to verify.

4. Signing: You sign the document digitally (using an electronic signature) or physically while the Commissioner watches on camera.

5. The Modified Jurat: The Commissioner signs and applies a "modified jurat" to the document. This special wording states that the document was commissioned remotely and lists the physical locations of both the signer and the Commissioner.

Which Documents Can Be Done Online?

Most documents that require an Oath, Affirmation, or Declaration can be completed remotely, including:

• Affidavits (e.g., for court, OSAP, or insurance).

• Statutory Declarations (e.g., Common-Law Status, residency).

• Government forms requiring a Commissioner’s signature.

What CANNOT Be Done Online?

While technology has come a long way, Ontario law still requires in-person attendance for:

• Certified True Copies: A Notary must physically see and touch the original document to certify a copy.

• International Documents: Many foreign consulates or countries require a physical "wet ink" signature and an embossed seal.

• Wills and Powers of Attorney: These have very specific "virtual witnessing" rules that differ from standard commissioning.
