If you are planning a wedding outside of Canada, ensuring your legal documents are in order before you depart is essential. Foreign authorities often require proof that you are legally eligible to marry.

Common Document Requirements
While every country has its own specific rules, you will typically need the following:

• Statutory Declaration of Marital Status: A sworn statement (signed before a Notary) confirming you are currently single, widowed, or divorced.
• Statement in Lieu of a Certificate of Non-Impediment: Often issued by Global Affairs Canada based on your Statutory Declaration.
• Notarized Copies of Identification: Certified true copies of your Birth Certificate, Passport, or Driver’s Licence.
• Proof of Divorce (if applicable): Notarized copies of your Divorce Certificate or Final Divorce Order.

The Apostille & Authentication Process
Most foreign countries will not accept a Canadian notary's seal alone. Your documents may need to be authenticated or issued an Apostille certificate.

• Apostille Countries: Since January 2024, Canada can issue Apostilles, which simplify the process for over 120 countries.

• Non-Apostille Countries: May still require a multi-step process involving Global Affairs Canada and "legalization" at a specific Embassy or Consulate.
